A 38-YEAR-OLD man was airlifted to hospital after the digger he was driving overturned near Barnstaple on Sunday.

The incident happened in Filleigh near St Paul's Church at 10.45am.

Police believe the digger had been stolen or taken without consent. A witness saw the vehicle swerving on the road before crashing into a tree.

Police closed the road for a short time to remove branches of the tree which had fallen into the road.

Fire crews from Barnstaple and South Molton also attended the scene and cut the man free from the digger using hydraulic rescue equipment.

The man, who police say is local to the area, was then airlifted by the Devon Air Ambulance to the Royal Devon and Exeter Hospital with a suspected broken arm.

They should have left him by the side of the road until he had signed a confession statement. This would save public money when taking him to Court.
