A Welsh Premier League footballer who posted an abusive message about Plymouth’s Olympic diver Tom Daley will not face charges, the Director of Public Prosecutions has said.

Daniel Thomas’s message was “not so grossly offensive that criminal charges need to be brought”, Keir Starmer said.

New guidelines for prosecutors on social media cases will also be issued, given the growing number of complaints, he added.

Daley, 18, and diving partner Pete Waterfield missed out on a joint medal at this summer’s Olympics when they finished fourth in the 10m synchronised dive.

The Port Talbot Town FC midfielder posted a homophobic message on Twitter, which was later distributed more widely, leading to his arrest.

Mr Starmer said: “This was, in essence, a one-off offensive Twitter message, intended for family and friends, which made its way into the public domain.

“It was not intended to reach Mr Daley or Mr Waterfield, it was not part of a campaign, it was not intended to incite others and Mr Thomas removed it reasonably swiftly and has expressed remorse.

“Before reaching a final decision in this case, Mr Daley and Mr Waterfield were consulted by the CPS and both indicated that they did not think this case needed a prosecution.”

Tom is a fantastic role model for lots of young people. My son who attends the same school and the same diving club looks up to him and strives for similar success. he acknowledges it takes a lot of hard work, dedication and sacrifice to become even half as good as Tom. My son works hard because Tom does! He also checks out his 6 pack on a daily basis in the hope of one day securing a following of girls just like Tom! I know lots of children who look upto him as a role model. I for one would sooner my son followed in Toms footsteps rather than some good for nothing low life!

Gay or straight who cares? Gotta admit he looks good in his Speedo's... Sorry Adidas trunks (one of his sponsors! People have to remember that he had the publicity started when he was just 13 so he has sort of had to live with it as he has got older. He obviously has an appeal to gay men and younger girls so how clever of his PR people that they keep us all guessing by playing to both markets. At the end of the day isn't it better that he is a positive role model compared with "In Court Today" low life that regularly frequent this site. And jeffro11 He doesn't pose in the "skimpiest" of trunks. I think that's your own imagination running away with you! Strange that you take such an interests with him on Facebook and Twitter!

Personally i couldn't care less what his sexual preferences are and i don't do "TwitFace" but i do think his ego is becoming bigger than his talent. Having recently admitted he would like to be in a movie, bcome a television presenter, will be participating in the Girls Aloud tour, the X Factor special, albeit with other athletes plus photo-shoots,calenders and attending a so-called celebrity wedding i cannot see him participating in the next Olympic Games when it apparently takes 3 years to perfect a new dive. Someone stated he was a modern day "idol" and should be treated as one. Not by me.

@stevodevo if you read my comment to the end you will see i say he is a good athlete! Its the media whoring i detest! And it is true that most of these "storys" if you can call them that are released by the family ! If you asked most of the general public are fed up with hearing about a kid who came third ! Meanwhile the gold winning girl handles herself with grace and dignity! Why do we have to hear about him daley?? Lol did you see what i did there? ....genius!
