Damage is biggest cause of disputes over deposits

Disagreements over cleaning at the end of the tenancy is the biggest cause of disputes between letting agents and their tenants, tenancy deposit protection scheme My Deposits has said.

It says more than a fifth of disputes about the return of tenants’ deposits are caused by issues over the cleanliness of the property, with 18% of disputes down to disagreements over deductions to cover the cost of general redecoration.

A formal dispute can occur if agents and their tenants are unable to come to an agreement over the return of the deposit at the end of the tenancy.

The findings show that 17% of disputes are down to damage to the property caused by tenants, with 7% due to covering the cost non-payment of rent or outstanding bills and 5% to covering the cost of missing or replacement items in the property.

Suzy Hershman, head adjudicator at My Deposits, said: “We’ve been dealing with agents’ deposit disputes for over six years now.

“Some are unaware of where they are going wrong but if they can understand what is ‘best practice’ right from the start and throughout the tenancy, then this will help to avoid a formal deposit dispute occurring at the end.”
